ORDINANCE NO. / gig- ,RLII AN ORDINANCE PROVIDING FOR THE IMPOUNDMENT OF MOTOR VEHICLES PARKED UPON REAL PROPERTY WITHOUT CONSENT OF THE OWNER OF SAID PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY OF TIFFIN. BE IT ENACED by the City+ Council of the City of Tiffin, Iowa: SECTION I. PURPOSE. The purpose. of this Ordinance is to protect the health, safety, and welfare of the citizens of the City of Tiffin, Iowa, including but not limited to - the protection of said citizens ' rights to the peaceful use and enjoyment of their real property, by providing for the impoundment of motor vehicles parked upon real property without said property owner' s consent. SECTION II. MISDEMEANOR, It is hereby declared that the parking of a motor vehicle upon real property without : the consent of said property owner is a nuisance under the provision of Chapter 657 . 1 and 364. 13 ( 3) of the IOWA CODE ( 1979) shall be deemed a violation of traffic regulations and a misdemeanor. SECTION III. OWNERS OF REAL PROPERTY. If any vehicle is parked upon private property in violation of Section II of this Ordinance, the property owner shall the Mayor, notify Chief of Police, or any other' peace officer. Prior to the removal of any motor, vehicle, the owner of the real property or lawful possessor thereof, or the agents of either shall in writing sign a formal complaint with the City of Tiffin, copy of the complaint to go to the police officer who- takes the complaint, a copy to the complainant, a copy to be firmly attached in a visible place on the vehicle and . a copy for the City of Tiffin. The Police Department of the City of Tiffin, Iowa, is hereby authorized to act as the agent of any real property owner or lawful possessor thereof to contact a qualified towing firm to remove the motor vehicle parked in violation of this Ordinande.
