Formanek recommended 8% increase for Brown and 4% increase for Kern. Rohret recommended 5% increase for Brown and 5% increase for Kern. Spivey recommended 5% increase for Brown and withheld comment on Kern. Citizen Bill Bream wished to go on record stating that Brown deserves an 8% increase. Potter recommended 8% increase for Brown and 5% increase for Kern. Madden recommended 8% increase for Brown and 5% increase for Kern.
Motion Spivey second Rohret to defer decision of salaries for Ralph Brown and Adelia Kern for FY 1982 to regular meeting on July 8, 1981 or until the time that the full council is present. Roll call vote: Madden, aye; Potter, aye; Spivey, aye; Rohret, aye. Carried unanimously.
Motion Potter second Rohret to set date for public hearing on request by Greg Downes to rezone lot nos. 1 and 2 of Sadler Subdivision from R-1 to R-3 and lot nos. 3, 4 and 11 from R-1 to R-2 for July 8, 1981. No action taken because date of July 8th does not allow enough time for legal publication requirements.
Motion Madden second Rohret to instruct clerk to publish request by Greg Downes for rezoning of lot nos. 1 and 2 in the Sadler Subdivision from R-1 (single family residential) to R-3 (multi-family) and lot nos. 3, 4 and 11 in the Sadler Subdivision from R-1 (single family residential) to R-2 (duplex), and to forward request to the Planning and Zoning Commission and to set date for public hearing on the matter for Wednesday, July 22, 1981 at 7:00 p.m., and Barbara Murray will take minutes because Clerk Kern will be in Ames, Iowa. Carried unanimously.
Bill Bream addressed Council concerning expansion of business and installation of liquid fertilizer tanks. Barbara Murray recommended rezoning to A-1 because homes are adjacent to property. Bream stated that he would have three ingredient tanks containing nitrogen, phosphoric acid and potash and would cold mix fertilizer. Bream also stated that substance would be stored in steel, non-pressure tanks and moved with non-pressure hoses to transport trucks. Bream asked Council for indication of its feelings on matter. Madden stated that she did not know how community feels on issue. Spivey stated that he opposed liquid fertilizer because of odor, closeness to residences and possible problems it would create. Mayor Formanek and Rohret stated they would approve of rezoning property to reflect its current usage. Attorney advised Bream that if 20% of the property owners within 200 feet adjacent to rear or directly opposite his property sign a protest against rezoning, then he must have four out of five council votes to approve rezoning. Mayor Formanek asked councilmembers if 20% of property owners adjacent to property leased by Bream were against rezoning, would they vote for or against rezoning. Every councilmember present stated that he would go with the people's wishes. Council suggested that Bream poll owners within 200 feet of business.
Spivey asked Bream why he moved business to the east of Grant Street when McCrabb had agreed to build west of Grant Street only. Bream stated that he has 600 feet frontage leased from the Chicago, Rock Island and Pacific Railroad Company and that he took over exactly what McCrabb had leased.
