Item 5 on the agenda: Robert Mickelson - request approval for subdivision plat of the Michel Subdivision located 1 1/2 miles west of Tiffin.
Roger Formanek: This item has gone to Planning and Zoning. There is a summary by JCCOG.
Barbara Murray: All the concerns required in your subdivision ordinance have been addressed by the Johnson County Board of Supervisors and approved of.
Ted Spivey moved to approve the subdivision plat for the Michel Subdivision. Motion seconded by Potter.
Roll Call:
Madden - Yes
Potter - Yes
Spivey - Yes
Rohret - Yes
Williams - Yes
Mayor declared the motion carried.
The Mayor signed five copies of the drawing of the plat. One copy will be brought back to Tiffin City Clerk after the Board of Supervisors signs the plat drawing.
Roger Formanek announced the next item on the agenda, the appeal of Gaylord Augustine case concerning removal of mobile home from lot at 210 Summerhay Street.
Roger Formanek: This matter has cost the City $172 to date to take this concern to court. I think the City should continue the appeal because of the principal involved. The odds of Tiffin winning this case in district court is almost nil because a mobile home had been removed. We acted on this originally because of a citizen complaint. Notice was served and disregarded and case went into the legal process. Fine has not been paid because the case has been appealed to a higher court by the defendant.
Mary Hoefer: Believes the City has gotten what it wants - the mobile home has been moved. It will be at least two hours of attorney time to continue the legal process and there is no definite amount of fine that will be paid to the City even if the City does win the case.
