MINUTES TIFFIN CITY COUNCIL The Tiffin City Council met in special session on July 22, 1981, at the Tiffin Methodist Church for the purpose of holding a public hearing on rezoning request by Greg Downes and request by Robert Mickelson for approval of Michel Subdivision. Mayor Formanek called the meeting to order at 7:00 P.M. Councilmembers present were Madden, Potter, Spivey, Rohret, Williams. Absent: none. Also present were Mary Hoefer, City Attorney; Barbara Murray, JCCOG, serving as temporary clerk; Ralph Springmire, Greg Downes, Robert Mikelson, John Schneider. Community Forum The Mayor asked the question if there would be any discussion from the community. No discussion presented itself. The Mayor announced the first order of business. Greg Downes' request for rezoning Lots 1 and 2 in the Sadler Subdivision from R-1 (single family residential) to R-3 (multi-family). Greg Downes spoke. In the event that the lots would be sold in the future it is a negative point to have a non-conforming use. He would like the lots to be zoned to their existing use. If destroyed by fire there would be a question of whether the apartments could be rebuilt unless they were rezoned. Mary Hoefer: Would recommend approval. It would help Tiffin's ordinance if challenged in court, to show a plan of various kinds of zoning usage. Especially in this case when the zoning would conform to the existing use of the property, the property should be rezoned. The Mayor asked if the Council has received a zoning staff report from JCCOG. All had received the report. Ted Spivey questioned how many units could be rebuilt on the lots. Greg Downes: The number of units would have to conform to ordinance square footage requirements. Roger Formanek: The request for rezoning was sent to Tiffin's planning and zoning June 17, 1981. The Planning and Zoning Commission did not meet to discuss this request Since it is more than 30 days since they received the request, the Council may now act without Planning and Zoning recommendation.
