Mayor Potter called the meeting to order at 7:00 p.m. Councilmembers present were Cox, Brown, Spivey, Rohret. Stevens was absent. Also present were Attorney, Hoefer, Engineer Hart, Barbara Bechtoldt, Judd TePaske, Dick Meyers, Don Sehr Ralph Stoffer.
Motion Spivey second Brown to approve agenda. Carried unanimously.
Sehr stated that the Board of Supervisors was concerned about the stipulation in areas 3 and 5 that the county could not rezone any land.
Stevens arrived at 7:06 p.m.
Sehr did not see why Tiffin would be concerned about approving a couple of tracts for farmers who wanted to build houses for their sons, etc. He felt that this would not make much difference to Tiffin. Cox stated that the concern was that the county not rezone any land without first notifying the city in order to prevent another situation like DeKalb. Sehr agreed to notify the city of any rezoning requests in areas 3 and 5, or that the county not approve anything commercial in those areas. TePaske pointed out that there was a big distinction between a 15-20 lot subdivision and approving one lot for a relative to build a house. Council could agree to limited residential development but no large scale subdivisions. Approving one or two lots could limit the ability to deny approval for larger project. Board needs to develop language for one or two lot zoning with some limitations. Sehr stated that the Board could not go along with not rezoning any agricultural land. Board could see objections to commercial or large scale subdivisions, but no problems with one or two houses.
TePaske stated that the council and board should come to preliminary consensus during each step, draw up administrative procedures and then hold a public hearing. TePaske stated that language changes would be made in areas 3 and 5 and he would talk to attorney about administrative procedures so they are standardized for all communities.
Motion Stevens second Brown to approve area 6 as presented. Roll call vote: Cox; aye; Brown, aye; Spivey, aye; Rohret, nay; Stevens, aye. Carried.
Motion Stevens second Brown to approve area 7 as presented. Roll call vote: Cox, aye; Brown, aye; Spivey, aye; Rohret, nay; Stevens, aye. Carried.
Sehr stated that area 1 was subject to approval by city for rezoning. Board is giving city more power on areas 1, 2, 4, 6 and 7 and less on areas 3 and 5. TePaske stated that city will be informed of any rezoning and subdivision requests for all areas and board will be informed by city of any annexation requests. Attorney will send written comment to clerk and then meet to draft 25B Resolution.
Motion Cox second Rohret to adjourn. 7:28 p.m. Carried unanimously.
