Potter stated that he would like to ask the city to sell the 35,000 gallon water standpipe and 2 furnaces from water plant and a lawnmower. Cox stated that furnaces were old and could possibly malfunction, leaving city liable. Council consensus to dispose of furnaces, rather than sell them, and authorize mayor to sell lawnmower. Engineer Schumacher stated that the water standpipe will not serve any purpose after the new 100,000 gallon is installed. Council instructed engineer to draw up specifications of 35,000 gallon water standpipe so it could be advertised for sale. Engineer reported that the fifth foundation of the new tower makes it necessary to move an existing water main. The city will not be out of water, but will have reduced pressure when work is being done. Attorney Greenleaf stated that according to Code of Iowa, Chapter 364.7, sale of property must be done by resolution and city must publish date, time and place of public hearing between 4 - 20 days before hearing. At the public hearing, the council may pass the resolution and sell the property. Council set date for public hearing to sell water standpipe for June 13, 1984 at 7:30 p.m. Stevens stated that he would talk to Sheriff Hughes about protection problems in town. Mayor reported that he and Ralph Brown are going to test sewer lines for depth when dry and during a rain, in order to find infiltration sites. Motion Morgan second Spivey to approve clerk-treasurer's reports. Carried unanimously. Motion Cox second Stevens to approve bills and accept receipts. Carried unanimously. Mayor announced that council was going to close the session to discuss pending litigation by Louis Voparil. It was discovered that tape recorder was not available so council did not close meeting. Attorney Greenleaf stated that Voparil's suit had been revived last year, and according to statute, must be inactive for one calendar year before it is considered dropped. He also reported that it is currently inactive and no action will be taken by council. Clerk reminded council that it should not discuss matters in open session. Motion Stevens second Cox to adjourn at 8:15 p.m. Carried unanimously. MAYOR, GLENN R. POTTER CLERK-TREASURER, ADELIA S. KERN
