Cox asked engineer where City stood with money paid to Service Enterprise Corp. Engineer stated that City had paid for all work completed. After project is completed, the engineering firm will put together a change order for liquidated damages and Service Enterprise Corp. will decide whether or not to sign it. Cox asked if Council put time limit on projection completion last month. Engineer stated that his understanding was that the clock would stop when the inside of the tower was painted. Spivey stated that it was the Council's understanding at the time of the last change order that all other work would be completed before the inside of the tower was painted, including site work. Attorney stated that he did not recall conversation last month. Clerk stated that last month's minutes show that the attorney had expressed some concern over whether clock should stop when the inside of the tower was painted because the site work was not yet complete, but that the Council consensus was to agree upon 43 days for liquidated damages. Kobold read excerpt from last month's minuted for clarification. Engineer said that the attorney and Baker will decide if the clock stopped when the inside was painted at the time the change order for liquidated damages is drawn up. Spivey stated that the agreement was not to charge for curing time or disinfecting time. Kobold reported that Brown needed new gauge for tower. "Engineer will check to see if gauge is in contract and take care of it. Motion Spivey second Kobold to approve clerk-treasurer's reports. Carried unanimously. Motion Cox second Spivey to approve bills and accept receipts. Carried unanimously. Motion Cox second Morgan to adjourn at 8:50 p.m. Carried unanimously. [Signature] GLENN R.
