Greenleaf: You're holding money and are at an advantage now. Wrap up everything. Once the final work is completed, send a check for balance due minus liquidated damages.
Potter: We still have the guage, site work and overflow problem.
Snyders: The hole is repaired but not checked. Will check in the spring. Site work yet to be done is outlined in the memo. Service Enterprises will subcontract that. An estimated $500.00 worth of work is remaining.
Potter: Could get bid to finish the remaining work from a sub contractor and change with a work order from Service Enterprises.
Attorney: If Service Enterprises doesn't sign that change order it is their responsibility to complete work.
Snyders: When they left they had full intentions of finishing work. The last payment asks for $1800.00. The $500.00 is included in that. You are not making a final payment. You are making a periodic payment. Final payment is the retainage money. The tower is not accepted until then. Do we need a change order on liquidated damages?
Attorney: I'm not sure.
Potter: Payment request says 100% complete. There's still $500.00 worth of cleanup left.
Snyders: Normally held in retainage money. There's enough money there to cover it.
Potter: Herdlska is satisfied with settlement.
Snyders: Hold retainer for 30 days. The $1800.00 payment does not go against the $7295.00.
Motion Morgan second Spivey to approve periodic payment request by Service Enterprises Corporation of $1800.00. Carried unanimously.
Snyders: Will check into how to finalize contract. Change order issued or actually deduct from contract. Attorney will contact Snyders tomorrow. Engineer can bring final pay estimate to Council next meeting.
Cox suggested tagging pets for a $2.00 fee. It would make it simplier to identify animals and City would know that all pets are vaccinated. Ryan stated that there are a lot of cats on Clear Creek and they are getting into traps set by trappers and they have no way of knowing if cats have been vaccinated. Ryan would agree to taking duties of animal control officer and will contact clerk about details of contract.
