February 10, 1988 over $4700.00 had been spent so far, with the $1100.00 refund from the Southeast Iowa Emergency Medical Services going directly back to the First Responders. Motion Spivey second Stoner to approve request from First Responders for an additional $500.00 to purchase heavy weight jackets. Roll call vote: Stratton, aye; Spivey, aye; Morgan, aye; Stoner, aye. Carried unanimously. Mayor instructed Stratton to check into purchasing a sprayer which could be used for dust control on streets and for spraying duck weed on sewer ponds. Morgan reported that sewer line at 230 W. Second Street (Kirk Madden's) had been hooked up wrong. Herring told Runge about problem because Runge was in charge of the sewer and Runge said he would inform Mayor Potter. Herring thought problem has been solved. The hookup was made into an abandoned field tile in the ditch, two feet west of the stub to the main line. Morgan stated that this was an honest mistake on Herring's part and was not his fault. Herring asked Smelser Construction to repair problem and it was done on February 8th. Morgan stated that Herring has asked for direction from the council concerning his responsibilities for water/sewer hookups in the future. Spivey: The person who is hired to install the line should be qualified and should be bonded. Potter: Madden hired Rugger. Hart: The digger should know when he's hit the sewer line. Spivey: A qualified person would know. Rugger would not come back and fix it. He was called several times and asked to fix it. Potter: I told Bob to get it fixed. Attorney Greenleaf: Legally, the home owner is responsible for the hookup. The city called in for repair. Madden should have gone after Rugger to repair the problem. City should pay repair bill and send letter to Madden to repay city. Madden can go after Rugger for the amount, if he wants to. Morgan: Getting back to Herring's responsibility, if he says its not okay, what can he do about it? Hart: Most contractors are cracking into the line. They should be required to dig into the "Y". Potter: Herring called Hart for the location of the "Y" at Madden's and the diggers stopped short. Hart: Herring will learn with more experience. Morgan: It's Herring's responsibility to know where the mains are. He can call Hart for locations. The contractor should know what he's doing. Hart: Herring has the right to look, but it's not his authority to say if it will work.
