Attorney reported that City of Tiffin gave quit claim deed to Clear Creek School to rectify recording error in original deed, leaving exhibit "A" intact. Dr. Williams will deed a few feet south of the water tower fence line back to the City.
Paul Ollinger of Oak Cable in Huxley, Iowa presented proposal for cable television in Tiffin. Oak is a subsidiary of Trinity Engineering. They have built 84 systems in the last five years. Issue would need to go to public election. Fifty percent or more of the voters would have to approve. City is not bound by vote but could then issue a non-exclusive franchise. Oak would pay for election and publication. City would pay attorney fees. No other cost to the City. Oak would appropriate pay taxes. Three percent franchise fee would go back to City. Cables are underground. Would probably push under the streets rather than tear them up. Oak would put everything back to its original shape. Would probably try to lease property from City. Would build system in late summer. Cannot guarantee prices for customers because companies receive price increases from suppliers. Council will place item on next month's agenda.
Mayor reported that it appears that Breams Bins and Buildings is being used to store tires. Attorney stated that it appears that the use of Bream's Bins and Buildings is in violation of present zoning. There is a provision in the Zoning ordinance to prosecute for violations. Mayor directed attorney to proceed with prosecution. Spivey stated that if the other ordinances are going to be enforced, then this one should be enforced, too, but someone should first find out exactly what it is being used for.
Motion Spivey second Eggers to investigate use of Bream's Bins and Buildings and if it is in violation of Zoning Ordinance to turn zoning violation over to attorney for prosecution. Roll call vote: Spivey, aye; Stoner, nay; Stratton, aye; Eggers, aye; Morgan, aye. Carried.
