Mayor Potter called meeting to order at 7:00 p.m. Council members present were Spivey, Stoner and Stratton. Eggers and Morgan were absent. Also present were Mike Hart, Stephen Greenleaf, John Schneider Lloyd Williams and a Johnson County Sheriff's deputy.
Motion Stratton second Spivey to approve agenda. Carried unanimously.
Motion Spivey second Stoner to approve minutes of regular meeting November 9, 1988. Carried unanimously.
Hart reported that he had not been able to reach General Electric Credit Corporation concerning right-of-way for water tower. Greenleaf stated that unless the easement was recorded, it probably was not any good. Potter appointed Ted Spivey to talk to Bill Rogers about obtaining an easement to the water tower from Roberts Ferry Road.
Attorney reported that he is waiting for title objections from bankruptcy action on 141 Railroad Street. Hart report that survey is completed.
Council consensus to install wooden rail fence, similar to fence around playground, at 141 Railroad Street as soon as possible and to post two "no trespassing" signs.
John Schneider requested rezoning of portions of lots 3 and 4 of the Sadler Subdivision from R-1 to C-1. He plans to purchase a portion of each lot to make the fence square around the Ice Cream Store. Attorney reported that lot no. 4 would be in violation of the zoning ordinance for R-1 if it was reduced in size because the lot contains 9,600 square feet currently and the ordinance requires 12,600 square feet (90' by 140'). Lot no. 3 has over 17,000 square feet and would not appear to be in violation by reducing it 1400 square feet. Schneider could ask the Board of Adjustment for a variance for lot no. 4.
Motion Stoner second Stratton to refer request by John Schneider to rezone portions of lots no. 3 and 4 of the Sadler Subdivision from R-1 (single-family residential) to C-1 (commercial) to the Planning and Zoning Commission. Carried unanimously.
Motion Spivey second Stratton to approve application by General Telephone Company to bury cable according to drawings provided. Carried unanimously.
Hart reported that he notified Richard Rugger that the drawings for buried cable for television are not specific enough. The maps do not show houses or cables running to the houses. Hart also noted that Rugger has not buried the cable according to the drawings and notified him that if his cable is cut by other digging, Rugger Communications will be responsible. Hart also reported that he told Rugger to remove control boxes from the ditches, but that has not been done. Hart reported that Rugger's insurance bond is on the way.
No report on Holiday Decorating Contest because Eggers was absent.
Hart asked the council to consider purchasing a used six inch mobile trash sludge pump for the sewer plant because it would save money in the long run.
