Motion Gericke, second Bartels to approve a RESOLUTION NO. 2001-18, RESOLUTION AUTHORIZING CITY ENGINEER TO INSPECT, APPROVE AND RELEASE A CERTAIN LOT IN JOHNSTON -POTTERFIELD SUBDIVISION AS TO A CERTAIN DEVELOPMENT AGREEMENT. Ayes: Dils, Gericke, and Bartels. Absent: Walls, and Ryan. Motion carried.
City Attorney had requested closed session for the purpose of legal strategies regarding injunction from Joe Johnston to claim a certain portion of Third Street described as his property. City did not proceed into closed session. Planning and Zoning had turned down a request from Joe Johnston to change zone of this lot from R-1 to R-3. Attorney Greenleaf explained that Mr. Johnston had taken the action of injunction when the clerk reported Attorney Greenleaf's opinion that the most northern area of concern appeared to have been used as street for an extended period of time, and could continue in this same use. Attorney Greenleaf has asked for assistance from Hart in location of pins for this lot and will respond in this matter. Hart has reported an erroneous legal description in the injunction filed. Mayor Potter following earlier communication directed that Attorney Greenleaf file all and any answer required in this matter to preserve possession of the city used street. Greenleaf explained that he had provided counsel to Joe Johnston at earlier date in unrelated matter. Council agreed that they felt Attorney Greenleaf could represent city interest without conflict.
Motion Bartels, second Gericke to adjourn. Motion carried. 7:22 p.m.
