Minutes of Regular Council Meeting, Tiffin, Iowa, February 3, 1965 Present: Glen Potter, Ted Spivey, Bill Bream, Bill Verry Ned Allen Absent: Wayne Stratton OLD BUSINESS: Annexation. This has been discussed with Ned Allen before, and during the past week something has come up which makes him feel that a decision should be made now instead of waiting until some future time. According to the Code and the Guide for Annexation, if an adjacent property owner requests annexation the Town Council can take action on this by passing a resolution (a majority of the Council) to annex this area. Following this resolution, the Town would be required to file a description of the annexed property in the County Recorder's office. In the case of the Allen property, there are three separate descriptions recorded in the courthouse, and Ned would propose that we annex two of these three separate described parcels. Therefore, we are only required to state the book and page number where this property is described plus a simple drawing made with the description of the proposal and submit to the County Recorder. It requires no expense on the part of either the Town or the property owner. If only a portion of a piece of ground is to be annexed, a survey would be required. The town has had trouble with several things in the past: the cement, asphalt and fertilizer companies, and now there is currently planned a north-south power line which would cut diagonally through Allen's property and the Myron Walker property and directly across the north-south road, and across the south corner of the interchange. The requirements of this once it is installed are that no buildings can be erected within 200 feet of this line, so this cancels quite a lot of that key property. It would take out about 10 acres. It also hurts the piece of property on the Walker farm that has recently been proposed as a school site, the possibilities of which have been discussed by school board members with the bank which holds the Walker property in trust. What we would not want to do then is to permit something to obstruct and cut us off from this land which is logically contiguous to this community. The high line is only in the rudimentary planning stage at this time, and now is the time to take action on it if we are going to try to preserve this stretch of land for the uses it most logically should have. It seems likely that the bank and the committee who has the Walker land in trust will go through whatever procedure is necessary that the Town annex this property. The school site was initiated some time before the power line came along. The Mayor and Councilmen read the letter from Ethel Allen requesting annexation of the property discussed. About 18 acres of their land is already in the town limits, and there are around 90 acres south of the road and 92 acres north of the road where the farm buildings are. Ted moved and Bill Verry seconded the resolution that this property be annexed as designated, to be effective on the date when it is recorded. Carried unanimously. Set Price for Use of Tractor. At the present time, it was decided that $5.00 an hour for use of the town tractor (operated by town employee) by private citizens would be a fair assessment. DeWaine submitted that 98 hours had been spent by him cleaning up the T. T. Meade property.
