G-1 - Ordinance 2021-478 - Pre-fabricated Garden Shed in Side Yard

CITY OF TIFFIN ORDINANCE NO. 2021-478 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF TIFFIN, IOWA, TIFFIN ZONING ORDINANCE NO. 2007-287, SECTION 9.05, ACCESSORY BUILDINGS AND STRUCTURES, TO ALLOW PRE-FABRICATED GARDEN SHEDS OF LESS THAN 100 SQUARE FEET IN A SIDE YARD BE IT ENACTED by the City Council of the City of Tiffin, Iowa: Section 1. Purpose: The purpose of this ordinance is to amend Tiffin Zoning Ordinance No. 2007-287, Section 9.05, Accessory Buildings and Structures, to allow pre-fabricated garden sheds of less than 100 square feet in a side yard. Section 2. Amendment. Section 9.05 – Accessory Buildings and Structures, is hereby amended as follows: SECTION 9.05 ACCESSORY BUILDINGS AND STRUCTURES 9.05 ACCESSORY BUILDINGS AND STRUCTURES. (a) No accessory building or structure shall be erected more than 120 days prior to the time of completion of the construction or establishment of the principal structure or use where it is accessory. Accessory buildings and structures are limited to fifteen (15) feet in height and must be at least five feet from any main building or property line. No accessory building or structure may be erected in any yard other than rear yard and it must occupy less than thirty percent (30%) of the required rear yard, except for private garage, which may occupy up to 60% of the required rear yard. Private garages must meet minimum principal structure front, side, and rear yard requirements. Only one accessory building is permitted per residence in residential districts. (b) One pre-fabricated garden shed of less than 100 square feet is permitted in the side yard of a lot in a residential district and can be closer than five feet to any main building. The pre-fabricated garden shed of less than 100 square feet will be permitted even if the property already has one accessory building meeting the above stated requirements of Section 9.05(a). Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 4. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 5. When Effective. This ordinance shall be in effect after its final passage, approval, and posting as provided by law.
