floodplain ordinances and that the updated chapter incorporated the applicable alternatives. The
final chapter now includes updated floodplain management standards and requirements tied to
development, floodways, flood protection, elevation certifications and related standards. The
final penalty provision is also clarified at $500 maximum and/or 30 days, with each continuing
violation treated as a separate offense.
IX. Chapter 125 - Sexually Oriented Business Regulations
The final draft clarifies who administers sexually oriented business permits. The City
Administrator is identified as the person responsible for approving permits, rather than leaving
the Code with an undefined "Director." The signage provision has also been simplified to cross-
reference the City's general Sign Code in Chapter 167 rather than maintaining two potentially
conflicting sets of sign standards.
X. Zoning - Chapter 165 – Zoning Regulations - Home-Based Businesses –
(New/Updated)
This is another significant policy change. The former "Home Occupation" provision has been
replaced with a new Home-Based Businesses section. The new provision:
• Defines "home-based business."
• Creates a separate category for "no-impact home-based businesses."
• Allows home-based businesses in residential zoning districts.
• Allows no-impact home-based businesses by right without a City permit, license,
registration, variance, or other prior approval.
• Establishes standards intended to preserve the residential character of the neighborhood.
• Limits business activity to 49% of the total floor area of the dwelling and accessory
structures.
• Restricts exterior storage and displays.
• Regulates signage.
• Addresses noise, traffic, parking, deliveries, odors, smoke, dust and other potential
nuisances.
• Requires compliance with State law, including Iowa Code Section 414.33.
Other zoning updates
The zoning chapters have also been cleaned up and updated to:
• Clarify permitted/restricted/special exception uses.
• Update references to the Board of Adjustment.
• Correct zoning tables.
• Update temporary-use provisions.
• Coordinate fireworks sales regulations with State law.
• Correct cross-references to other chapters.
For example, the commercial zoning provisions now specifically address temporary structures
used for consumer fireworks sales and establish conditions for those uses.
