ROGERS COUNTY: Johnson PROJECT: City of Tiffin, Iowa IMPROVEMENT: Sanitary Sewer Main SELLER: WILLIAM J. ROGERS, unmarried (Fee) THIS AGREEMENT entered into this ____ day of ________________, 2022, by and between Seller and the City of Tiffin, Iowa, Buyer. 1. Seller agrees to sell and furnish to Buyer by easement documents, on forms furnished by Buyer, and Buyer agrees to buy casements on the following described real estate in Johnson County, Iowa: See Attached Exhibit A which is incorporated herein. Seller will grant to Buyer a fifty foot wide temporary construction easement, as provided in the agreement and plat marked Exhibit B, for the City to construct a permanent sanitary sewer main ("public improvement") for the City of Tiffin. Seller will grant and convey to Buyer a twenty foot wide permanent sanitary sewer easement as provided in the agreement and plat marked Exhibit C, for the City to construct the public improvement. 2. FEE TITLE. Seller owns fee title to the property described on the attached Exhibits. Seller acknowledges full settlement and payment from Buyer for all claims per the terms of this Agreement and discharges Buyer from liability because of this Agreement and the construction of this public improvement project. 3. PURPOSE OF THE ACQUISITION. The easements are being acquired for the public purpose of the City's construction and operation of a sanitary sewer main. 4. REAL ESTATE TAXES. The Seller shall pay all estate taxes against the parcel described on Exhibit A for periods prior to and after closing.
