16. Developer and Owners will create a condominium declaration containing residential covenants, conditions and restrictions that will be recorded and run with the PAD property. 17. Building faces will be not less than 22 feet from the private lane and at least 10 from each other. All buildings must be a minimum of 20 feet from Lilac Street. 18. Zoning density in R4 which allows for one 4-plex in 16,000 square feet or 1 unit in 4,000 square feet. This is equivalent to 10.89 units (households) per acre. Zoning density in R2 which allows for one 2-plex in 10,000 square feet or 1 unit in 5,000 square feet. This is equivalent to 8.712 units (households) per acre. The PAD ordinance allows the density to be increased by 10% in residential zoning or allows 11.97 households per acre. The proposed PAD site will have five 4-plexes, eight duplexes and one single unit, for a total of 37 units in 5.29 acres, which equals 6.99 households per acre. 19. The parking ordinance requires 1 space per bedroom plus 1 per four-plex. Each Unit on the PAD has 4 parking stalls, two in the unit and two in the driveway. 20. Lighting will be provided at each required intersection. 21. Developer, Owners and its successors and assigns agree to plant 37 deciduous trees in accordance with the site plan, and maintain a minimum of the 14 deciduous trees already on the property. 22. The Council has already approved of the site plan, but the Developer and Owners must present a final plat for approval. 23. Developer and Owners will execute an adequate Public Access and Fire Apparatus Easement Agreement, and such other utility easement agreements all to the satisfaction of the City of Tiffin. 24. Developer, Owners and their successors and assigns grant to the City an easement for access for any City Official acting in the course of his or her official duties.
