CONSTRUCTION AND DEDICATION AGREEMENT [DETENTION BASIN] TIFFIN, JOHNSON COUNTY, IOWA THIS AGREEMENT, made by and between the CITY OF TIFFIN, IOWA, a municipal corporation, hereinafter referred to as "City," and HAWK WASH, LLC, an Iowa limited liability company, hereinafter referred to as "Hawk Wash." SECTION 1. REQUEST FOR SITE DEVELOPMENT PLAN APPROVAL Hawk Wash has requested that the City approve Hawk Wash’s Site Development Plan for the following described real estate situated in Tiffin, Johnson County, Iowa, to wit: LOT 1, HOYT’S FIRST SUBDIVISION, JOHNSON COUNTY, IOWA, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 20, PAGE 41, PLAT RECORDS OF JOHNSON COUNTY, IOWA. (the “HW Property”) As part of this request, Hawk Wash acknowledges that it owns the above-described real estate. As part of this request, Hawk Wash shall construct a shared detention basin, and associated drainage infrastructure upon certain real estate owned by the City and located adjacent to the HW Property, as described in that Site Utility Plan forming a component of Hawk Wash’s Site Development Plan and attached hereto as Exhibit “A” (such improvements, collectively the “Detention Basin”). SECTION 2. CONDITIONS OF APPROVAL AND RIGHT TO PROCEED A. The City shall approve Hawk Wash’s Site Development Plan upon the conditions that: 1. The construction plans for any public improvements associated with the Site Development Plan (including, but not limited to, the Detention Basin) will be
