I-3 - Resolution 2025-009 - 28E Agreement for South Jasper Avenue

A. Coralville shall design and let the Project in compliance with Chapter 26 of the Code of Iowa. B. The Project consists of the following: All labor, materials and equipment necessary to construct Jasper Avenue south of the roundabout to be installed at Forevergreen Road and north of Andersen Place. C. Coralville will construct the entire Project, and Tiffin agrees to execute any and all permits necessary for the Project, including all permits required by the Iowa Department of Transportation to issue a permit for work in the Iowa Department of Transportation right-of-way necessary to construct the Project. D. Except for providing permits and cooperating with all parties regarding the Project, Tiffin shall have no responsibility for any cost of the Project. E. While Coralville is otherwise responsible for the entire cost of the Project, Tiffin will acquire any necessary construction easements from properties that will remain within its boundaries but border the Project to the west, and the property to the east which is south of Coralville’s boundary line. These shall be acquired by Tiffin prior to Coralville executing its conveyance to Rarick and prior to filing a dismissal in this case, Coralville’s City Attorney and City Engineer shall prepare such necessary construction easements and plats, subject to approval by City of Tiffin, which approval shall not be unreasonably withheld. Coralville shall provide said documents to Tiffin contemporaneously with the execution of this Agreement. F. The parties acknowledge that Jasper Avenue will need to be paved south of Coralville’s boundary lines in order to connect to Andersen Place. Tiffin agrees to cooperate with Coralville, including executing necessary right of way permits, to ensure this connection is made. G. After completion of construction of the Project, Coralville shall maintain the Project. Maintenance includes but is not limited to mowing, maintaining the surface of the road, and snow removal. Tiffin shall have no responsibility for any maintenance or maintenance costs of the Project, except for any maintenance costs that are solely due to the negligence of Tiffin or their officers, employees, or agents. H. Any sidewalks installed as part of the Project shall be maintained by the adjacent property owner or as provided in the ordinances of Coralville or Tiffin. I. Coralville agrees that the lots on the west side of South Jasper Avenue may have access to Jasper Ave consistent with Coralville’s and Tiffin’s normal access policies. Coralville agrees to allow lots in Tiffin which abut Jasper Avenue to have access to Jasper Avenue, with the understanding two lots may have a shared access onto Jasper Avenue. J. After construction of the Roundabout Project, which is governed by a separate 28E Agreement executed the same date as this 28E Agreement, is completed and accepted,
