CHAPTER 28E AGREEMENT BETWEEN THE CITY OF TIFFIN AND THE CITY OF CORALVILLE, REGARDING CONSTRUCTION OF SOUTH JASPER AVENUE This Agreement is entered into in between City of Tiffin, Iowa, a municipal corporation ("Tiffin") and the City of Coralville, Iowa, a municipal corporation ("Coralville"). Tiffin and Coralville are collectively referred to as “the Cities” hereinafter WHEREAS, Tiffin, and Coralville share a corporate boundary which runs approximately down the centerline of Jasper Avenue south of Forevergreen Road and north of Andersen Place; WHEREAS, Cities have entered into a Settlement Agreement which provides, in part, for the construction of Jasper Avenue south of Forevergreen Road and north of Andersen Place (“Project”); WHEREAS, Coralville has agreed to construct the Project; and WHEREAS, it is now necessary for Tiffin and Coralville to enter into a 28E Agreement to outline the obligations and responsibilities of each party as it pertains to the construction, payment and maintenance of the Project. NOW, THEREFORE, THE CITIES AGREE AS FOLLOWS: 1. Purpose The purpose of this 28E Agreement is to set forth the duties and obligations of Tiffin and Coralville in connection with the construction, payment and maintenance of the Project. 2. Consideration It is hereby expressly acknowledged by Cities that construction and maintenance of the Project by Coralville and the acquiring of temporary construction easements by Tiffin and partial release of jurisdiction by Tiffin and general cooperation by the parties in accordance with the terms and conditions set forth in this Agreement constitutes mutual and sufficient consideration to enter into this Agreement. 3. No Separate Entity Further, it is hereby noted that no separate legal entity shall be created by this Agreement and the Tiffin City Administrator and the Coralville City Administrator will administer this Agreement. 4.
