Hektoen, 115 Third Street SE, Suite 1200, Cedar Rapids, Iowa 52401, (319) 366-7641 80/380 COMMERCE PARK ADDITION SUBDIVIDER’S AGREEMENT THIS SUBDIVIDER’S AGREEMENT, (the “Agreement”) made by and between the City of Tiffin, Iowa, a municipal corporation, (the “City”) and 80/380 Commerce Park, LLC f/k/a The Villages, L.C., an Iowa limited liability company (the “Subdivider”) RECITALS A. Pursuant to Section 5.13(U)(ix) of the Subdivision Ordinance of the City, the Subdivider and City desire to memorialize the terms, obligations and benefits respecting the Subdivider’s development of the 80/380 Commerce Park First Addition subdivision. SECTION 1. REQUEST FOR PLAT APPROVAL The Subdivider has requested that the City approve the preliminary plat, attached hereto as Exhibit A-1 and incorporated herein by reference, for a proposed subdivision (the “Subdivision”) known as 80/380 Commerce Park First Addition (referred to herein as the “plat”) for the following legally described real estate situated in Tiffin, Johnson County, Iowa, to wit: See Exhibit A-2, attached hereto and incorporated herein by reference. As part of this request, Subdivider acknowledges full ownership of the real estate described above. SECTION 2. CONDITIONS OF PLAT APPROVAL AND RIGHT TO PROCEED A. The City shall approve the preliminary plat of the Subdivision upon the following conditions: 1. The final plat(s) will conform to the preliminary plat; 2. The construction plans will be submitted and approved by the City;
