RESOLUTION NO. 2024-045 28E AGREEMENT BETWEEN THE CITY OF TIFFIN AND THE CLEAR CREEK AMANA COMMUNITY SCHOOL DISTRICT FOR SHARED USE OF THE CITY’S AND DISTRICT’S FACILITIES This agreement is entered into between the City of Tiffin, Iowa, a municipal corporation (“City”), and the Clear Creek Amana Community School District (“District”). WHEREAS, the City has created a Recreation Department under the direction of the Tiffin City Council, and; WHEREAS, the City would like and will need to conduct some of the recreation programs on the premises of the District, and; WHEREAS, the District currently has middle school baseball and softball programs and that use City facilities and may have other programs in the future that will use City facilities and; WHEREAS, the District will have a soccer program beginning in the Fall of 2024 that will use City facilities, and; WHEREAS, the City and the District desire to enter into a 28E agreement pursuant to the Code of Iowa for the use of each other’s respective facilities for the benefit of the public. NOW, THEREFORE, THE CITY AND THE DISTRICT AGREE AS FOLLOWS: 1. The purpose of this Agreement is for the District and the City to share facilities. 2. The term of the Agreement shall be from July 1, 2024 - June 30, 2027. This Agreement shall automatically renew for successive three (3) year terms unless either party gives written notice to the other of non-renewal by them immediately preceding June 1. 3. The Clear Creek Amana Community School District Superintendent and the Tiffin City Administrator, or their respective designees, shall have the authority to enact and facilitate the provisions of the Agreement on behalf of the District and the City subject to directions, policies and actions which the Clear Creek Amana School Board and the Tiffin City Council may adopt. 4. The City shall pay the District an annual fee of $11,600 ($8,000 - facility rental & $3,600 - maintenance) for the use of the District’s facilities for practices, games and other requested recreation programs. The parties agree this fee will increase 5% each successive year unless either party gives written notice to the other for non-renewal by them immediately preceding June 1. 5. The City, through its Recreation Department, may utilize the District’s High School secondary gym, Middle School main and auxiliary gyms, Middle School PE/Exercise area (with potential summer use starting in 2025), Tiffin Elementary gym and Oak Hill Elementary gym. The City will have priority regarding scheduling the use of these facilities over all other non-District uses after all District uses have been met. The City may utilize the Clear Creek Elementary gym and Amana Elementary gym through the District facility usage scheduling platform. Usage of Clear Creek and Amana Elementary gyms are beyond the scope of this agreement and the usual and customary fees, as established by board policy, will be invoiced to the City. 6. The City shall not charge the District for the use of the City’s facilities for practices, games or other requested District programs.
