The City and Developer shall share the cost of any traffic light, turn land or other traffic control measure(s),such allocation of cost to be specifically approved by the City Council at a later date. The cost sharing may be included in the development agreement specified in the prior paragraph.” The following is inserted in lieu thereof: “All public improvements associated with N. Kimberlite Street, including but not limited to constructing N. Kimberlite Street and installing a traffic light at the intersection of N. Kimberlite St. and Highway 6, must be completed and accepted by the City prior to the issuance of any certificate of occupancy for Lots 54 and 55 in Prairie Village Part 3, Phase 4 subdivision.” 3. The last two sentences of Section 3(C)(4) of the 2022 Agreement are deleted in their entirety and the following inserted in lieu thereof: “This requirement includes the construction of a sidewalk along the west side of N. Kimberlite which is eight feet in width, and the construction of a sidewalk along the east side of N. Kimberlite which is five feet in width.” 4. The last sentence of Section 3(C)(4) of the 2023 Agreement is deleted in its entirety and the following inserted in lieu thereof: “The sidewalks to be installed along the streets abutting Outlot Z must be completed prior to the City accepting Outlot Z as provided for in Section 3(C)(10).” 5.
