RESOLUTION NO. 2024- 029 A RESOLUTION AUTHORIZING THE ENTERING INTO A DEVELOPER' S AGREEMENT WITH GHS DEVELOPMENT INC., TIFFIN, IOWA, FOR TIFFIN HEIGHTS WEST Whereas, MMS Consultants, Inc., on behalf of GHS Development, Inc., has filed with the City of Tiffin a preliminary plat for Tiffin Heights West, a subdivision to the City of Tiffin, Iowa, legally described on the attached Exhibit hereby incorporated, and; Whereas, Resolution 028 2024- was approved by City Council on May 28, 2024, approving the preliminary plat for said development, and; Whereas, the Developer' s Agreement will include any and all particulars to the approved preliminary plat for Tiffin Heights West, Now, therefore be it resolved by the City Council of the City of Tiffin, Iowa, that the Attorneys representing GHS Development, Inc., and the City of Tiffin have reviewed and have taken under consideration all revisions to be made by the City Council of Tiffin. The City Council now requested having further reviewedthe Developer' s Agreement and do now approve the Agreement as printed and authorize the Mayor and City Clerk to enter into an agreement with GHS Development, Inc., to fully execute the document. On the 28th day of May, 2024, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Limkemann introduced RESOLUTION NO. 2024- 029,A RESOLUTION AUTHORIZING THE ENTERING INTO A DEVELOPER' S AGREEMENT WITH GHS DEVELOPMENT, INC., TIFFIN, IOWA, FOR TIFFIN HEIGHTS WEST with proposed language from developers attorney in section 3F and not to exceed 12. 5% for the future urbanization of Half Moon Road and made a motion for approval. Motion seconded by Councilperson Orris. Ayes: Havens, Olney, Orris, Schnedler, Limkemann. Nays: None. Absent: None. Whereupon five Council members were present and voted approval and Mayor Kasparek declared that RESOLUTION NO. 2024- 029,A RESOLUTION AUTHORIZING THE ENTERING INTO A S AGREEMENT WITH GHS DEVELOPMENT, INC., TIFFIN, IOWA, FOR TIFFIN DEVELOPER' HEIGHTS WEST with proposed language from developers attorney in section 3F and not to exceed 5% 12. for the future urbanization of Half Moon Road to be adopted and signified his approval of the same by affixing his signature thereto.
