TIFFIN HEIGHTS PAD AGREEMENT THIS AGREEMENT, made by and between the City of Tiffin, Iowa, a municipal corporation, hereinafter referred to as "City", and Midwest Home Builders, Inc., hereinafter referred to as "Developer". SECTION 1. REQUEST FOR PAD APPROVAL Developer is the fee simple owner of the following described real estate located in Tiffin, Johnson County, Iowa, to wit: Lot 29, Tiffin Heights Part One, to the city of Tiffin, Johnson County, Iowa, according to the recorded plat thereof. ("Real Estate") Developer has requested that the City approve the Planned Area Development ("PAD") Site Plan (the "Site Plan"), attached hereto as Exhibit "A" and incorporated herein by reference, for a proposed PAD area for the Real Estate. As part of this request, Developer acknowledges full ownership of the real estate described above. SECTION 2. CONDITIONS OF PAD APPROVAL AND RIGHT TO PROCEED A. The City shall approve the Site Plan upon the conditions that: 1. The construction plans for the PAD will be submitted and approved; 2. The public improvements will be constructed in accordance with approved construction plans and accepted by the City; and 3. The Developer enters into and abide by this Agreement.
