37.04 PERMIT REQUIRED. Noperson subject totheprovisions ofthischapter shalloperate anypremises without avalidpermit. 37.05 APPLICATION FOR PERMIT. Anyperson subject totheprovisions ofthischapter, shall file,induplicate, an application forapermit withtheFireMarshal onforms provided bytheFireMarshal. IftheFireMarshal isunavailable, theapplicant may filetheforms withtheFireChief. 37.06 ISSUANCE OF PERMIT. Uponthefilingofanapplication forapermit, theFireMarshal shall conduct an inspection ofthepremises toensure compliance withChapter 37ofthisCode of Ordinances. IftheFireMarshal findsthattheowner oroperator isincompliance with Chapter 37,theFire Marshal shallissueapermit uponpayment ofallpermit and inspection fees. Any person whose application forapermit isdenied mayrequest a hearing onthematter before theCityCouncil. Therequest forahearing shall befiled inwriting withtheCityClerk within (7)business daysfromthemailing ofthedenial to theaddress ontheapplication and remedy. 37.07 TERM OF PERMIT. Thepermit issued under thischapter shallbevalidforaperiod oftwo (2)yearsas listed onthepermit. 37.08 INSPECTIONS AUTHORIZED. 1. Authority. TheFireMarshal ishereby authorized toadminister andenforce the provisions ofthischapter andtomake inspections todetermine thecondition ofall premises within theCity, inorder thatsaidofficer mayperform thedutyof safeguarding thehealth, safety andwelfare ofthegeneral public undertheprovisions oftheFireCode. TheFireMarshal shall, uponproper service request, enforce the provisions ofthischapter andishereby authorized anddirected tomake inspections pursuant toorinresponse toaproper service request regarding analleged violation of theprovisions ofChapter 37oranyoftheapplicable regulations orrulespursuant thereto. Inabsence oftheFireMarshal, theFireChiefshallperform thisduty. 2. Inspections. Inspections oftheprovisions ofthischapter shallbeconducted upon request, onacomplaint basis, and/orthrough aprogram ofregular inspections which shallbeconducted every two (2)years. 37.09 TIME FOR INSPECTIONS. 1. TheFireMarshal ishereby authorized anddirected torequest entrance toinspect allpremises subject totheprovisions ofthischapter, between thehoursof8:00a.m. and5:00p.m.forthepurpose ofdetermining whether thereiscompliance withits provisions. 2. TheFire Marshal mayagree toaninspection byappointment atanytime. 37.10 COURT ORDER AVAILABLE. Iftheowner, operator, orotherperson incharge ofthepremises failsorrefuses to permit freeaccess andentrance tothepremises under partthereof, withrespect towhich aninspection authorized bythischapter issought tobemade, theFire Marshal orFireChief, uponashowing thatprobable cause exists fortheinspection andfortheissuance ofanyorderdirecting compliance with the inspection requirements ofthischapter withrespect tosuchpremises, maypetition andobtain suchorder fromacourtofcompetent jurisdiction.
