F 1- A 11re1 11111 AN ORDINANCE VACATING A PORTION OF RIGHT OF WAY IN TIFFIN, IOWA BE IT ENACTED by the City Council of the City of Tiffin, Iowa: Section I. Purpose: The purpose of this ordinance is to vacate a portion of right of way as described on the attached plat and convey it to the adjoining property owner. Such vacation has been approved by the Planning and Zoning Commission. Section 11. Findings: The City Council of Tiffin, Iowa, hereby makes the following findings: A. That the City of Tiffin held a public hearing on the following proposal: 1. The vacation of the public land on the attached plat, which right of way abuts Ireland Avenue. B. The right of way described above is not needed for the use of the public, and therefore, its maintenance at public expense is no longer justified. C. The proposed vacation will not deny owners of property abutting it reasonable access to their property. D. That under the provisions stated above, the above -described property is hereby vacated and declared no longer a part of the public streets and grounds of Tiffin, Iowa upon the conveyance of the property. Section 111. Repealer. All ordinances or parts of ordinance in conflict with the provisions of this Ordinance are hereby repealed. Section IV. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section V. When Effective. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. On the 17th day of July 2018, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Havens introduced Ordinance No. 2018- 441, and moved that it be given its first reading. The motion was seconded by Councilperson Bartles. Ayes: Schnedler, Havens, Upton, Bartles Nays: None
