CITY OF TIFFIN ORDINANCE NO. 2013- 332 AN ORDINANCE TO AMEND THE CITY OF TIFFIN IOWA SUBDIVISION ORDINANCE NO. 2012- 319, TO CHANGE THE TIME PERIOD UNDER SECTION 3. 05 MAINTENANCE BOND REQUIRED. BE IT ENACTED by the City Council of the City of Tiffin, Iowa: Section I. Purpose: The purpose of this ordinance is to amend Section 3. 05, City of Tiffin Iowa Subdivision Ordinance No. 2012- 319, to change the period for which the owner and subdivider of the land being platted shall be required to provide to the City proper maintenance bonds from ten ( 10) years to three ( 3) years. Section II. Amendment: Section 3. 05 of the City of Tiffin Iowa Subdivision Ordinance No. 2012- 319 is hereby replaced with the following: 3 . 05 MAINTENANCE BOND REQUIRED The owner and subdivider the land of being platted shall be required to provide to the City, proper maintenance bonds satisfactory to the City, so as to insure that for a period of three ( 3) years from, the date of acceptance of any improvement, the owner and subdivider shall be responsible to maintain such improvement in good repair. The City may, at its sole discretion, accept alternative sureties to maintenance bonds to insure the workmanship of the improvements accepted by the City. A performance bond will also be required per Section 5. 12 . Section III. Repealer. All ordinances or parts of ordinance in conflict with the provisions of this Ordinance are hereby repealed. Section IV. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section V. When Effective. This ordinance shall be in effect after its final passage, approval, and posting as provided by law.
