2 3 8 CITY OF TIFFIN ORDINANCE NO. 2000- AN ORDINANCE REPEALING ORDINANCE' 1998 - 220 AND AMENDING ORDINANCE 1980- 92 SECTION III( 1) TO CHANGE THE NUMBER OF DAYS FOR COMPLIANCE TO CUT OR DESTROY WEEDS OR GROWTH AFTER NOTICE TO CURE. WHEREAS, the City of Tiffin has determined that it is necessary to reduced the period for compliance, after notice to cut or destroy noxious weeds; therefore, BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section 1. Revocation: Ordinance No. 1998- 220 is hereby repealed. Section 2. Amendment: Ordinance No. 1980- 92 Section III, Subsection ( 1) is hereby amended and the following is enacted. Section III. 1. An order to destroy or cut weeds and growth shall state that the task shall be accomplished within three ( 3) days of the date of mailing of the notice to cure. Section 3. Penalty Provision. The city may elect, at its sole discretion, to prosecution any violation either as simple misdemeanor or a municipal infraction. Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 5. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 6. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as provided by law.
