TIFFIN, IOWA 52340
A special meeting of the Tiffin City Council was held November 19, 1974 at 6:00 p.m. at the Tiffin City Hall.
Mayor Brotherton presiding. Councilman present: Beverly Birtcher, Bill Bream, Roger Janssen, Glenn Potter, and Judy Smith. Also present: Attorney Neuzil, Hawkeye Engineering representative, and Doug Edmonds of the Johnson County Sheriff's office.
Glenn Potter introduced and caused to be read a resolution to fix a date of meeting at which it is proposed to take action for the issuance of $31,000 Sewer Bonds, and moved its adoption, seconded by Beverly Birtcher. Resolution carried by roll call vote.
Bill Bream introduced, caused to be read, and moved the adoption of a resolution providing for the advertisement of $31,000 Sewer Bonds. Roger Janssen seconded the motion. Resolution was adopted by roll call vote.
Doug Edmonds of the Johnson County Sheriff's office advised the council that in his opinion complaints against The Corral were insufficient to deny renewal of their liquor license. Mary Ann Spurrier, owner of the Corral, was present with legal counsel. She informed the council of actions she had taken to comply with state and city codes and that she was unaware of any city ordinances that were being violated. Mayor Brotherton advised the council that in his opinion this license should not be renewed because of the complaints that had been filed. Bill Bream made the motion to renew the liquor license for The Corral. Beverly Birtcher seconded the motion. Motion carried by roll call vote. Mayor Brotherton vetoed the motion citing two reasons: 1) numerous complaints filed against The Corral. 2) Violations he had witnessed at this establishment.
The question arose as to whether the mayor had the power to veto and this was not firmly established at this time. Discussion ensued among council members and Ms. Spurrier and her attorney. Motion remained vetoed.
Beverly Birtcher made the motion to have delinquent sewer bills sent to the county auditor for certification on the tax rolls. Judy Smith seconded. Motion carried by roll call vote.
There followed a unanimous motion to adjourn.
Mary Formanek, City Clerk
James E. Brotherton
Mayor
