she would not object to a duplex on lot no. 11 but did not want anything other than a house or a duplex built there. Petition presented to Council does not have any reasons stated on it. Spivey: Received staff report from Johnson County Council of Governments on request by Downes. Spivey requested that report be read starting with "Chapter 414 of the Iowa Code" on page two. Formanek and clerk read report. Spivey: Why does report call for rezoning of College Street? Murray: Refers only to cul-de-sac area of College Street and property that borders lot nos. 1, 2, 3, 4 and 11 of the Sadler Subdivision. Kammerer left to attend another meeting in Solon. Formanek asked for a motion to approve or disapprove request by Downes. Rohret: Would like to see lot nos. 4 and 11 rezoned to R-2 and lot nos. 1, 2 and 3 rezoned to R-3. Potter asked clerk to read recommendation of Planning and Zoning Commission in regard to request. Commission recommended that lot nos. 1, 2, 3, 4 be rezoned R-3 and lot no. 11 be rezoned R-2. Motion Rohret to rezone lot nos. 1, 2, 3 in the Sadler Subdivision from R-1 (single family residential) to R-3 (multi-family) and rezone lot nos. 4 and 11 from R-1 (single family residential) to R-2 (duplex). No second. Mayor Formanek declared motion failed for lack of a second. Potter: Lot no. 4 should stay as it is. It borders on J. Kobold's, H. Verry's and B. Michel's and would affect them. Motion Potter to rezone lot nos. 1, 2 and 3 of the Sadler Subdivision from R-1 (single family residential) to R-3 (multi-family) and to rezone lot no. 11 from R-1 (single family residential) to R-2 (duplex) and to leave lot no. 4 R-1 (single family residential). No second. Mayor Formanek declared motion failed for lack of a second. Schneider asked what would keep someone from using the house on lot no. 4 as a duplex anyway. He stated that is was built for a duplex with separate entrances on the inside. Spivey: Area does not conform with duplex zoning at this time. Formanek asked that the issue be resolved. Motion Spivey to deny request by Greg Downes to rezone lot nos. 1, 2, 3, 4 and 11 of the Sadler Subdivision from R-1 (single family residential) to R-3 (multi-family). Motion seconded by Williams. Discussion: Potter stated that it would be a big mistake to say no to all of rezoning. Only talking about two lots anyway. Williams stated that the issue was settled when it was originally zoned. Downes stated that he did voice his opinion at the zoning hearings for the original zoning. Stated also that there is some question about the market value of apartments which are on lots zoned for single family houses. Also stated that the city has to provide space for multi-family and commercial developments somewhere. Madden
