The Tiffin City Council met in special session on Thursday, May 7, 1981 for the purpose of holding a public hearing on rezoning requests by Greg Downes and Beverly Birtcher. Request by Downes: Rezone lot nos. 1, 2, 3, 4 and 11 of the Sadler Subdivision from R-1 (single family residential) to R-3 (multi family). Request by Birtcher: Rezone lot at 321 Grant Street from R-1 (single family residential) to R-2 (duplex). Mayor Formanek called the meeting to order at 7:00 p.m. Council-members present were Madden, Potter, Spivey, Rohret and Williams. Also present were Attorney Hoefer, Engineer Kammerer, JCCOG representative Murray, Greg Downes, Beverly Birtcher, John Schneider, A. F. Streb, Mr. and Mrs. Dick Lehman, Ralph Springmire, Ann Verry, Dave Kacena and other citizens. Mike Kammerer stated that rezoning would continue to reduce water pressure but not a significant amount. Will discuss accuracy of data in water and wastewater report at the regular meeting on June 10th. Mayor Formanek read a petition with 49 signatures which was presented by Jerry Kobold. Petition asked that zoning of lot nos. 1, 2, 3, 4 and 11 of the Sadler Subdivision remain R-1. Formanek asked for community input from citizens. No community input. A. F. Streb, owner of lot no. 3 Sadler Subdivision, stated that he did not know anything was happening concerning rezoning of lot no. 3. He stated that he wished to have the zoning remain R-3 "as he bought it." Mayor pointed out that lot no. 3 was never zoned R-3 and that Council had received letter from Greg Downes stating that Downes was acting on behalf of all the property owners of said lots. Lot no. 3 was zoned R-1 ever since zoning went into effect in September of 1979. Streb stated that he wished to have lot no. 3 zoned so that he could build an apartment on it. Potter: Already have apartments on lots no. 1 and 2. Lot no. 4 has a house on it. Lot nos. 3 and 11 are vacant. Rohret: Lot no. 4 is too small for R-3 zoning. Potter: Rezone lot no. 3 for R-3 and lot no. 11 for R-2. Williams: Council held zoning hearings when zoning went into effect. Sees no reason to change zoning now. City already has low water pressure. Kammerer: Water line service to buildings have some impact on pressure. Pumps keep standpipe fairly full at all times. Hoefer: Courts do not consider water and sewer capacity considerations as a way of rezoning. Courts believe that cities should expand facilities rather than limit population. Recommends that Council not consider water and sewer capacity in this issue.
