The Tiffin City Council met in regular session on October 14, 1981 at the Tiffin Methodist Church. Mayor Formanek called the meeting to order at 7:33 p.m. Councilmembers present were Madden, Potter, Spivey, Rohret and Williams. Also present were Mary Hoefer, Mike Kammerer, Barbara Murray, Ray Scheetz, Ralph Springmire, Paul Springmire, Tom Aubrecht, Julia Lyon and several students from her high school class. Motion Potter second Madden to defer discussion of the garbage contract since the city has not received it, and to approve agenda as amended. Carried unanimously. Motion Madden second Spivey to approve minutes of September 9, 1981 Carried unanimously. Ray Scheetz presented survey by Hawkeye Engineering of the Clear Creek Mobile Home Park, but stated that three engineering firms had done the survey and there were several discrepancies. Kammerer stated that the engineering firms would have to get together and reach an agreement. Motion Spivey second Rohret to defer issue of placement of dike in Clear Creek Mobile Home Park until engineering firms can solve problems of differing surveys. Carried unanimously. Kammerer will report to city attorney on matter. Mayor Formanek stated that the easement for right to access for construction of dike has not yet been signed or recorded. Discussion of alley adjacent to Leland Smith property. Paul Springmire, owner of property immediately west of Leland Smith's, spoke to council. If alley is vacated, he would be cut off from only access to garden. He had a fire a year ago and if alley is vacated, his fire protection would be diminished. He asked why Mr. Smith couldn't build garage extension to south and eliminate need to vacate alley. Spivey and Madden reported that they talked to several citizens who did not want city to vacate alley. Rohret stated that Smith had plenty of room to expand garage to south or east. Motion Spivey second Madden not to consider vacating alley adjacent to Leland Smith's property. Roll call vote: Madden, aye; Potter, abstained because he owns property adjacent to alley; Spivey, aye; Rohret, aye; Williams, aye. Carried. Motion Madden second Spivey to defer request by Leland Smith to obtain building permit for garage expansion until he presents a drawing which does not use alley space. Carried unanimously. Potter expressed concern about the 1981 street repair program. Kammerer explained that Iowa Road Builders did some scarifying, but reached a hard surface without regrading all of it. They hauled out some base in order to get a better bank and curve and a smooth transition. They did not charge for rock. Potter expressed concern over the timing of the work. Kammerer stated that he told contractors to do work at another time but they chose the busiest times of day to close the road. Kammerer stated that he was dissatisfied with the timing of the work but was satisfied with the way in which the work was done. Motion Rohret second Spivey to remit 90% of Iowa Road Builder's bill now and the remaining 10% after thirty days and after the clearance of lien waivers. Carried unanimously.
