The Tiffin City Council met in regular session on Wednesday, November 11, 1981 at the Tiffin Methodist Church. Mayor Formanek called the meeting to order at 7:30 p.m. Council members present were Madden, Potter, Spivey, Rohret and Williams. Also present were Mike Kammerer, Mary Hoafer, Tracy Smith, Barbara Smith, Jim Neuzil, Ray Scheetz, Dennis Brown and other residents. During the community forum Barbara Murray reported that the Johncon County Board of Health had contacted her concerning a complaint about junk motor vehicles on the Bill Verry property. Motion Potter second Spivey to approve agenda. Carried unanimously. Motion Rohret second Madden to approve minutes of October 14, 1981. Carried unanimously. Kammerer reported that the dike built by Ray Scheetz is entirely on city property. He advised the city to consider four points before entering into an agreement with Scheetz. 1) Raise manhole for sanitary sewer located near end of dike, 2) Fill low areas which were left from grading operations, 3) Remove large pile of trees and brush at south end of dike, 4) consider agreement whereby Scheetz maintains driveway entering sewage treatment plant. Potter stated that city lost one acre of ground and crops and now has two options; 1) tear out dike or 2) sell ground to Scheetz. Scheetz stated that manhole was raised 16 inches and filled in around it. Attorney stated that it would take a public hearing and resolution to sell the property. She advised that granting an easement would require less paper work and achieve that same result. The first resolution is voided due to the change in legal description of the ground. Motion Rohret second Spivey to set date for public hearing to consider granting of easement or selling of property adjoining Clear Creek Mobile Home Park and which has dike on it to Ray Scheetz for the purpose of constructing and maintaining a dike for Tuesday, November 24, 1981 at 7:00 p.m. Carried unanimously. Motion Spivey second Rohret to instruct clerk to notify Williams Realty to make an appraisal of property being considered at hearing on November 24, 1981 and to assess the cost of the appraisal to Ray Scheetz. Carried unanimously. Scheetz agreed to pay the cost of the appraisal of this property. Motion Rohret second Potter to instruct Attorney Hoefer to contact John Schneider and inform him that the city will not bring charges at this time concerning pavement of driveway and parking lot at the Ice Cream Store if he draws up agreement whereby the driveway and parking lot at the Ice Cream Store will be paved before he opens the store in the spring, or the city will bring an injunction against him to close the store. Carried unanimously. Potter reported that Louis Voparil is asking $23,000.00 for property at 221 Main Street. Motion Potter second Madden to have property at 221 Main St. appraised before further consideration by Council. Roll call vote: Madden, aye; Potter, aye; Spivey, aye; Rohret, aye; Williams, aye.
