CLASSIFICATION FROM OF CERTAIN PROPERTY R-1 (SINGLE-FAMILY RESIDENTIAL) AND A-2 (RESTRICTED AGRICULTURAL) TO M-1 (INDUSTRIAL) at 141 Railroad Street. Bream: I have a hard time with why it was zoned residential in the first place. Spivey: When McCrabb came in, there wasn't any zoning. He promised a lot of people a lot of things and none of it was done. I'd like to see something that would benefit the town. Bream: I question the legality of the original zoning. Spivey: The original plan put everything on the highway as commercial and everything else as residential. Stratton: People wanted it done that way. Spivey: McCrabb had to get permission from residents within 300 feet. This is how the business got started. Bream: It takes 2-4 months each time. Spivey: If it looks good, a special meeting could be called. Bream: People see R-1 and turn their back. Kern: If it is rezoned to M-1 tonight and someone comes in with a request which does not fit into M-1 uses right now, would he still have to go through the whole procedure? Attorney: Yes. Hart: Could the council discuss other options now which would be acceptable? Kern: Yes, but they could not make a decision since it's not on the agenda. Attorney: Right. Kern: The state law describes the procedure. It hurts small towns who only meet once a month. The council hears the request and then the P&Z has to wait until after the next regular council meeting to hold a public hearing. There's no way to get around that. The only way to speed it up is to call a special council meeting right after the P&Z meeting to get a final decision. Roll call vote on motion to deny reading proposed ordinance to rezone Bream Bins and Buildings from R-1 and A-2 to M-1: Spivey; aye; Stoner, nay; Morgan, aye; Stratton, aye. Carried. Potter read letter from attorney to Bill Bream concerning the apparent violation of Zoning Ordinance No. 83 for tire storage. Bream: This is the first I've heard about it. I have no record of that letter. Potter: What can we do about that? Attorney: It was mailed May 16th. Assuming it's still in violation, a citation could be issued. It was not required to be sent registered mail. Potter: Send another copy by registered mail and go from there. Do we have the correct address? Bream: Yes. Hart reported that drainage problem at 130 Summerhays Street is not the city's responsibility. The ditch going to the garage is lower than the ditch by the street. The ditch by the street needs to be lowered in order to catch the flow of water from the garage. The garage was built too low. Motion Morgan second Stratton to deny request by Doug Stackly to correct drainage problem on his property at 130 Summerhays Street because the city did not create the problem and it is on his private property. Carried unanimously. Discussion of cable television proposal from Jeff Rugger: Potter: Rugger is 50 cents lower than Valley Cable.
