Mayor Potter called meeting to order at 7:00 p.m. Council members present were Morgan, Stoner, Stratton, Eggers and Sboivey. Also present were Mike Hart, Stephen Greenleaf, Ken Castek, Todd Kimm and Deputy Ron Meyer.
Motion Morgan second Stoner to approve agenda. Carried unanimously.
Motion Stratton second Eggers to approve minutes of June 8, 1988 and June 21, 1988. Carried unanimously.
Attorney Greenleaf reported that Bill Bream phoned him after receiving certified letter concerning use of property at 141 Railroad Street. Bream informed the attorney that he no longer owned the property but would not tell him who owns it now. Greenleaf checked ownership records at the court house and sent the letter to Reta Bream. Clerk reported that copies of the minutes from May 11 and June 8, 1988 were sent to Reta Bream at her request.
Potter: Reta called me and asked how we could prove they are storing tires there and requested letter showing how we got into the building. (City did not inspect inside of buildings.)
Stratton: The tires were stored outside.
Eggers: I saw tires outside and saw vehicles going in and out.
Attorney: You could obtain a search warrant with probable cause. You have reason to believe an ongoing violation is occurring there. There appears to be evidence that tires are being stored there. It could be successfully prosecuted.
Stratton: Is storing tires there against the ordinance?
Attorney: People could store a few tires of their own at their house, but it appears they are operating a business there.
Stoner: I've seen a tire truck but no tires. Let's just drop it for now.
Stratton: Maybe the tires aren't there anymore.
Sboivey: I haven't noticed any tires lately.
Morgan: I agree. We could pursue it again later if need be. I hate to run up legal bills. We should all try to take notice of what goes on.
Potter: If anyone sees a violation, call me or the attorney.
Stratton: I've only seen their own vehicles lately.
Attorney: You've given notice now. You can assume the violation has ceased unless you see evidence to the contrary. I don't believe there were any time limits on the notice. If you see proof, you could pick it up from there. If you're not certain what's happening now, you could have a problem proving a violation.
Hart: Is it an actual business?
Stoner: He called me quite some time ago and said he had it leased to someone for six months.
Deputy Meyer: The Sheriff could use his business call list to find out what is going on.
Hart reported that he received the bid from Bob Smelser for repairs to sewer system right before the meeting but that it is invalid because of misinterpretation of the bid tab. Hart stated that he has been working with Smelser for six weeks to get the bid, but would seek other bidders now, as well as ask Smelser to resubmit. Bids will be due by July 30th.
AN ORDINANCE AMENDING THE TIFFIN MUNICIPAL CODE REQUIRING AN APPROVED DRAINAGE PLAN TO OBTAIN A BUILDING PERMIT; SETTING REQUIREMENTS FOR SUCH STORM DRAINAGE THAT MUST BE MET; AND PROVIDING PENALTIES AND REMEDIES FOR VIOLATIONS was introduced by Sboivey and moved that it be given its first reading. Second by Stoner. Attorney
