Mayor Potter called meeting to order at 7:00 p.m. Council members present were Morgan, Stoner, Stratton, Eggers and Spivey. Also present was Bob Michel, Todd Kimm, Mike Hart, John Schneider, Marvon Vorel and Charles Pope.
Pope addressed council during community forum to update activities and services of Iowa-Illinois Gas and Electric Company.
Potter stated that Iowa-Illinois will help to train fireman to handle an electric fire at sub-station.
Potter reported that Rugger will begin cable installation in Tiffin in mid-October.
Marvin Vorel addressed council during community forum concerning tree on neighbor's property at 310 Summerhays Street which overhangs onto his property and abandoned wells on both properties which might pose a safety hazard. City has no jurisdiction over tree. Engineer Hart will look at wells and advise as to proper fill and capping requirements. Vorel also expressed concern over letter he received about pet doberman running at large. He stated that the dog is never off his property unless it is with him. Ordinance requires pets to be on leash when off the owner's property, even if pet is with owner.
Motion Spivey second Stoner to approve agenda. Carried unanimously.
Motion Eggers second Spivey to approve minutes of August 10, 1988 and special meeting August 10, 1988. Carried unanimously.
Michel reported that Greenleaf did not file zoning violation charge against Reta Bream at 141 Railroad Street (formerly Bream Bins and Buildings). He sent a letter indicating that he had received a report that someone had been moving tires in and out of the building. Michel reported that he had received a call from Iowa State Bank which is considering taking the property back. The bank had some zoning questions.
Spivey: I don't see any reason to pursue it too hard if the bank is taking it back.
Potter: What should we do?
Hart: Repossession could take one year.
Michel: It may be a shorter time.
Morgan: Was any activity seen last month?
Stoner: I saw his truck down there.
Spivey: I called the attorney the day after the last meeting and told him I saw a truck unloading tires that day. They're in and out all the time. I've seen Bill's pickup there, too. We enforce the other ordinances; we should enforce this one, too. He can't be using it for another year.
Stoner: Sign a complaint. No one else sees it.
Potter: I'm sure there is activity there. I'd sign the complaint. He should have come to the council and asked.
Hart: If rezone, you'd open it to everything else if that business doesn't last.
Potter: Make up your mind who is running the city.
Stratton: We told Mr. Greenleaf to file the charges at last month's meeting. I understood that he was going ahead with it.
Eggers: Why do we need a new action now?
Potter: There is activity there. I'll sign the complaint form if I'm home to see it.
Spivey: Others saw him, too.
Stratton: Ted called the attorney's office about it last month.
Spivey: Yes. I gave the date, time, description of truck and everything else.
