Mayor Potter called meeting to order at 7:00 p.m. Members present were Eggers, Morgan, Stoner, Spivey and Stratton. Also present were Helen Bryant, Nadine Ball, Tim Wolfe, Tim Spivey, Greg Stevens, Gregg Geerdes, Jerry Vani, Barry Kimm, Sheriff Carpenter and two deputies.
No one spoke during community forum.
Carpenter asked to move his agenda item to the beginning of the meeting because he had to leave early.
Carpenter: I've received input over the last month that you are not satisfied with our service. I need to hear that from you at a meeting or I will consider that you are satisfied. I haven't gotten to many meetings like I promised. My representatives have missed some meetings. I want to be contacted with problems. Don't take it out on the dispatcher who answers the call or other officers. I contacted Stoner and he was not aware of any problems. I apologize if I misrepresented myself by saying I'd be at every meeting. I think I said someone would be at every meeting.
Spivey: That's right. That is what you said.
Carpenter: Sometimes that just isn't possible.
Spivey: We understand that.
Carpenter: You might want to raise the contracted hours for more services, but right now I don't have the manpower to do that. We received complaints that people were drinking outside at Slim's while playing volleyball. An officer talked to Greg Stevens who indicated that he had a beer garden permit.
Stevens: No. I didn't say that. I talked to Des Moines. I told them I played volleyball outside and they said I had to indicate that on my drawing. Their attorney indicated there wasn't any problem.
Carpenter: There are four requirements for an outdoor service permit: a drawing of the area, the hours and days it will be used, permission from the city council and showing proof of insurance. I called and was told that Slim's had a violation; that there should be no beer consumed on the property. Greg got a different story from Des Moines so I called the attorney of the Iowa Beer and Liquor Commission and he said as long as the beer is not consumed on public property, there was no violation. Public property includes the sidewalk and the street. It is legal to consume the beer or wine on Greg's property because he is the owner. He can't serve any alcoholic beverage outside. Two weeks ago we arrested three people who were drinking on public property. We issued citations on parking, too. Customers can take the beer or wine out the door in an opened container and drink it on Greg's property. They cannot consume it on the sidewalk or street. You could go into an ordinance like Solon and Iowa City to regulate open containers. Greg's license shows that he can serve only inside his building. If someone else buys a keg and sits it on his property, like the renters who live upstairs, and he has nothing to do with it, then that is okay, too.
Morgan: What about the street dance?
Carpenter: I'm not sure that's legal. Does he serve beer outside?
Stevens: Yes.
