CHAPTER 55 ANIMAL PROTECTION AND CONTROL B. The electronic device is attached to or worn by the dog or attached to an item worn by the dog, including (but not limited to) a collar, harness, or vest. 2. This section shall not apply to an act taken by any of the following: A. The owner of the dog, an agent of the owner, or a person authorized to take action by the owner. B. A peace officer. C. A veterinarian. D. An animal shelter or pound. 55.19 FALSE REPRESENTATION OF SERVICE ANIMAL. A person commits the offense of intentional misrepresentation of an animal as a service animal or a service-animal- in-training if, for the purpose of obtaining any of the rights or privileges set forth in State or federal law, the person intentionally misrepresents an animal in one’s possession as one’s service animal or service-animal-in-training or a person with a disability’s service animal or service-animal-in-training whom the person is assisting by controlling.
