a. It is further agreed that the Association must maintain and house all fire protection and other
emergency and non-emergency equipment, whether existing at the time of the agreement or
acquired during the term of the agreement, used under this agreement until transitioned to the
City. The Association must provide sufficient personal protective equipment for the firefighters
and emergency medical providers to use in performing their duties. The City may purchase
equipment for use by the volunteer firefighters or EMS providers.
b. The City, its officials and personnel shall be permitted to access, operate, and use any property,
facilities, equipment, or personal protective equipment without restriction until such property,
facilities, equipment and personal protective equipment are transferred to the City. This shall
not be construed to place any operational limits on City employees operating the equipment
under this agreement. (This is intended to be in response to an emergency situation and all
personnel must be trained prior to operating such equipment).
c. The Association will continue oversight and responsibility for equipment and facilities until
transferred to the City.
7. Contract for Services with Townships. The City and Townships may separately enter into a 28E
agreement for the provision of emergency services to the Townships. The Association agrees that
the Townships will provide all consideration to the City on or after July 1, 2021, and that the
Association will continue to provide equipment for the provision of services to the Townships using
members of the City fire department throughout the transition period. The Association’s obligation
shall conclude when the transition is complete and once the City is prepared to deliver services to
the Townships.
8. Budget. The Association shall control its budget for the operation of the department and for all major
and minor expenses, such as purchases of new fire vehicles and major equipment, to be paid for
during the term of this agreement. The budget shall include a separate line item for fire and rescue
equipment, and EMS equipment. The budget for expenditures shall be available to the City Council
or City Administrator upon request. The Association will provide bank statements and associated
documents to the City for inspection and review upon request.
9. Operational Expenses. The Association shall remain responsible for operational expenses, including
fuel, utilities (water, gas, electric), garbage, station internet, travel, parts, supplies, maintenance, and
equipment until this agreement is completed or the term expires.
10. Information Technology. The City will provide, and the members of the fire department will use,
the computers, hardware, and software necessary to operate the fire department.
11. Responsibility for Existing Obligations. The Association shall remain responsible for all existing
contractual obligations or debt during the term of this agreement. The Association shall provide
the City with a report and any information requested regarding finances, contractual obligations,
and debt upon request. The Association shall not enter into any contractual obligations or debt,
except upon the agreement by the City. The City shall pay off the two debts of the Association,
which are currently $405,000 for a pumper truck and $65,000 for a tanker truck at the completion
of the transition.
12. Automatic and Mutual Aid Agreements. The Association shall provide the City with all automatic
or mutual aid agreements in effect no later than June 14, 2021, for review.
On or after July 1, 2021, the Fire Chief, or the City designee, shall negotiate all automatic or mutual
aid agreements. As of July 1, 2021, the City shall be responsible for all new automatic or mutual
agreements. The City shall have all powers related to existing automatic or mutual aid agreements,
