Freeman and Teresa Lee Freeman (“AKAAY”) (443 Marengo and AKAAY, each, a “Party,” and collectively, the “Parties”), and is consented to by the City of Tiffin, Iowa, a municipality (the “City”) as evidenced by the City’s execution below. RECITALS WHEREAS, 443 Marengo is the owner of that certain real property located in Johnson County, Iowa described as: Lot 30, Tiffin East, Tiffin, Iowa, according to the plat thereof recorded in Book 34, Page 6, Plat Records of Johnson County, Iowa (the “443 Marengo Property”); WHEREAS, AKAAY is the owner of that certain real property adjacent to the 443 Marengo Property and located in Johnson County, Iowa and described as follows: Lot 12, Valley Subdivision to Tiffin, Iowa, (a resubdivision of Lots 13 through 22 and Outlot “A” of Tiffin East Subdivision, Tiffin, Iowa, and Lot 2, Hoyt’s First Subdivision), according to the plat thereof recorded in Book 37, Page 20, Plat Records of Johnson County, Iowa (the “Freeman Property”), having acquired title from Chad L. Freeman and Teresa Lee Freeman by Warranty Deed recorded June 4, 2026, in Book 6768, Page 795, records of the Johnson County Recorder; WHEREAS, 443 Marengo and Chad L. Freeman and Teresa Lee Freeman were parties to that certain Cross-Access Easement Agreement dated February 24, 2020, recorded on December {00684509}
