E. Temporary Turnaround Easements. Temporary easements for use as temporary dustless surfaced turnarounds are required on portions of Outlot “A” and Outlot “C”. Furthermore, Outlot “C” cannot be sold, transferred, or built upon until Longboat Drive is extended to the north, unless a separate temporary turnaround is provided and approved by the City.
F. Dust Control Measures. As part of the maintenance of roads, the Developer agrees to control dust on Halfmoon Avenue NW from the northerly terminus of Coquina Avenue to the northerly terminus of Longboat Drive by regular applications of calcium chloride treatment as necessary. Regular applications shall mean a minimum of two times per year, generally in the spring and in the fall. Developer’s obligation shall cease once Halfmoon Avenue NW is improved with a chip/seal, asphalt or concrete surface. Further, developers/subdividers of property using Halfmoon Avenue NW will pay a prorate share of the cost of such treatments based on the acreage of such land utilizing Halfmoon Avenue NW. Developer’s obligation in this regard may be transferred to the homeowners association. Developer understands City may require a Petition with the final plat documents which allows the subdivision to be assessed in the future for public improvements to Halfmoon Avenue NW.
G. Sanitary Sewer. The Developer shall construct a public sanitary sewer extension of sufficient capacity to serve the subdivision and additional property not yet developed, at no expense to the City, except as provided herein. The Developer will install the sanitary sewer pursuant to the plans and specifications approved by the City. Said sanitary sewer shall be available for connection on the west side of Halfmoon Avenue NW. Developer shall be responsible for the installation of the necessary mains, lines and laterals within the subdivision. The City shall reimburse Developer 67.50% of the actual costs of such extension within thirty (30) days of the presentation of invoices and the acceptance of the public improvement by the City. At the time of City Reimbursement, Developer shall also convey the sanitary sewer and provide sufficient easement agreements and easements to the City, as approved by the City.
H. Water Main. The Developer shall construct a public water main extension of sufficient capacity to serve the subdivision, and additional property not yet developed, at no expense to the City, except as provided herein. The Developer will install the water main pursuant to the plans and specifications approved by the City. Said water main shall be available for connection on the west side of Halfmoon Avenue NW. Developer shall be responsible for the installation of the necessary mains, lines and laterals within the subdivision. The City shall reimburse Developer 67.50% of the actual costs of such extension within thirty (30) days of the presentation of invoices and the acceptance of the public improvement by the City. Prior to or at the time of City Reimbursement, Developer shall also convey the water main and provide sufficient easement agreement and easements to the City, as approved by the City.
I. Fencing. Prior to final plat approval the Subdivider must comply with the fencing requirements of the Tiffin Design Standards, currently found in Chapter 16. This includes, but is not limited to, the construction and maintenance of all fences between the boundary of the subdivision and abutting land used for agricultural purposes, and entering into appropriate fence agreements prior
