Draft chapter 165: Zoning Regulations

§ 165.30 Restricted Use Permit

The 2026 draft's § 165.30; it has no counterpart in the current code.

Comparison with a draft: not adopted. The archive holds no public hearing, ordinance or vote adopting the recodified Code through the October 20, 2026 meeting packet. Until one is adopted, every page here compares the consolidated code with a draft that can still change: the revised draft with the October 6 changes is not in the archive.

A comparison with the August 2026 draft recodification prepared by Iowa Codification for the City. The draft has not been adopted and can still change; the current code (unofficial compilation) governs until a recodified Code is adopted. Matches between sections are made by machine from the texts and are reviewed where uncertain.

§ 165.30 Restricted Use Permit

Where in this Zoning Code a restricted use permit is required, the following procedures for submission and approval by the Zoning Administrator shall be followed:

1. An application for a restricted use permit, available from the Zoning Administrator, shall be completed in full and filed with the Zoning Administrator along with the required application fee.

2. Supporting information is provided with the application for a restricted use permit including a site plan indicating setback lines, building locations, proposed and existing uses and other such information as the Zoning Administrator may require.

3. A signed and attested statement from the property owner indicating compliance with all provisions of this chapter and a detailed explanation of any permitted nonconformities on the subject property is submitted to the Zoning Administrator.

4. The property owner submits to the Zoning Administrator other information and supporting documentation as required by the specific zoning district in which the permit is sought.

5. The Zoning Administrator shall determine compliance with this Zoning Code has been achieved based on the information provided by the applicant and other investigation as deemed necessary by the Zoning Administrator. Within 20 days of receipt of a complete application the Zoning Administrator shall act upon the application. Failure to make a determination within 20 days shall constitute a determination of noncompliance and the permit is automatically denied.

6. Permit Expiration. All restricted use permits issued under this chapter shall expire and are null and void on the date which shall be 12 months after issuance, unless work shall have been commenced under such permit prior to such date. At any time after 24 months, the Zoning Administrator may revoke the permit upon finding construction progress is not proceeding expeditiously.

7. Required Compliance Certificate and Zoning Permit for Permit Holders. All holders of restricted use permits shall apply for a zoning permit prior to beginning construction and a certificate of zoning compliance within 30 days of completion of the improvement for which the restricted use permit was secured.
