CITY OF TIFFIN IOWA ORDINANCE NO. 2018-428 AN ORDINANCE TO AMEND THE TIFFIN ZONING ORDINANCE NO. 2007-287 AMENDING SECTION 3.05, ADDING EXCEPTIONS TO THE FRONT YARD SETBACK AND AMENDING SECTION 1.05(B) DEFINITIONS TO ADD A DEFINITION FOR HABITABLE SPACE BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section 1. Purpose. The purpose of this ordinance is to amend Zoning Ordinance No. 2007-287, Section 3.05, Single-Family Residential Zoning Districts, by adding exceptions to the front yard setback, and amending the Definitions section of the Zoning Ordinance to add a definition for Habitable Space. Section 2. Amendment. Section 3.05, Single-Family Residential Zoning Districts; the following is added to section 3.05. For properties zoned: R-1A, R-1B, R-1C, R-1D: Adding exceptions to the R-1A, R-1B, R-1C and R-1D residential districts to allow habitable space and covered porches to encroach up to 10 feet into the front yard setback, while still complying with side yard width requirements. Section 3. Amendment. The following is added to section 1.05(B) Definitions: Habitable Space: A space in a building for living, sleeping, eating or cooking. Storage rooms, Utility rooms, garages and similar spaces are not considered habitable spaces. Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 5. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 6. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. On the 6th day of March 2018, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2018-428, and moved that it be given its second reading. The motion was seconded by Councilperson Upton.
