CITY OF TIFFIN ORDINANCE NO. 1996-210 AN ORDINANCE AMENDING ORDINANCE NO. 1996-204 (ZONING ORDINANCE) OF THE MUNICIPAL CODE OF TIFFIN, IOWA REGARDING APARTMENTS ON THE SECOND FLOOR OF BUILDINGS IN C2 COMMERCIAL ZONES. BE IT ORDAINED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section 1. Purpose: The purpose of this ordinance is to amend City of Tiffin Ordinance No. 1996-204 Section 5.07(H)(1) to include apartments on the second floor of buildings as a permitted principal use in C-2=Highway Commercial District zones. Section 2. Amendment: City of Tiffin Ordinance No. 1996-204, Section 5.07(H)(1) is hereby amended by adding the following thereunder as Paragraph (r): (r) Apartments, provided that they are located on or above the second floor of the building in which they are located. Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 4. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 5. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as provided by law.
