RESOLUTION NO. 2020-056 On this 16th Day of June, 2020, at the regular meeting of the Tiffin City Council, Tiffin, Iowa Councilperson Havens introduced RESOLUTION NO. 2020-056, A RESOLUTION TO PROCEED WITH FOREVERGREEN ROAD CONSTRUCTION PROJECT AND HAVE UPDATED APPRAISAL and made a motion for approval. The motion was seconded by Councilperson Schnedler. PROCEEDING WITH THE PUBLIC IMPROVEMENT PROJECT AND HAVING APPRAISAL UPDATED WHEREAS, on October 16, 2018, the Tiffin City Council approved Resolution No. 2018-101 Setting A Public Hearing On The Intent To Acquire Or Condemn If Necessary All Or A Portion Of Property Or An Interest In Property For A Public Improvement, The Forevergreen Road Construction Project WHEREAS, a Public Hearing was held on November 20, 2018, on the intent to acquire or condemn if necessary a portion of properties and/or an interest in properties for the public improvement, The Forevergreen Road Project. WHEREAS, on November 20, 2018, the Tiffin City Council approved Resolution No. 2018-108 Approving The Public Improvement, The Forevergreen Road Construction Project And Retaining An Engineer, Appraiser And Attorney. WHEREAS, on June 4, 2019, the Tiffin City Council approved resolution No. 2019-077 Establishing Just Compensation For Acquisition Of A Portion Or An Interest In Certain Real Estate Owned by John Powell Rarick and Robert Rarick As Trustees Of The Trust Created In The Last Will And Testament Of Ruth E. Rarick, Deceased, For The Forevergreen Road Construction Project. This was based on an appraisal prepared by Hal Kleinsmith dated May 14, 2019. This Resolution instructed that negotiations begin with the Trust. WHEREAS, on August 20, 2019, the Tiffin City Council approved Resolution 2019-100 A Resolution Authorizing Condemnation of land owned by John Powell Rarick and Robert Rarick as Trustees of the Trust created by the Last Will And Testament of Ruth E. Rarick, deceased. WHEREAS, on August 23, 2019, John Powell Rarick and Robert Rarick as Trustees of the Trust u/w/o Ruth E. Rarick filed a Quit Claim Deed dated August 22, 2019 to the City of Coralville, Iowa for the South 250 feet of the Trust’s property, which contains the area to be condemned by the City of Tiffin for its public improvement Forevergreen Road Construction Project. WHEREAS, on October 1, 2019, the Tiffin City Council approved resolution No. 2019-111 Establishing Just Compensation For Acquisition OF A Portion Or An Interest In Certain Real Property Owned By The City of Coralville, Iowa With Reverter Rights To John Powell Rarick And Robert Rarick As Trustees Of The Trust Created In The Last Will And Testament Of Ruth E. Rarick, Deceased, For The Forevergreen Road Construction Project. This was based on an appraisal by Hal Kleinsmith dated September 19, 2019. WHEREAS, on December 3, 2019, the Tiffin City Council approved Resolution No. 2019-125 Authorizing Condemnation of real property owned by the City of Coralville, Iowa with
