RESOLUTIONNO.2020-018 ARESOLUTIONAPPROVINGTHEFINALPLATOFPARKPLACECITYCENTER PARTTWO,PHASESIX Whereas,Andersen Development Inc. asSubdivider hasfiled withtheCityClerk ofthe CityofTiffin, Iowa, anapplication forapproval ofthefinalplatofPark Place CityCenter PartTwo, Phase Six, asubdivision ofTiffin, Johnson County, Iowa, which islegally described asfollows: Seeattached Exhibit thatisincorporated intothisagreement: AndWhereas,TheCityEngineer hasdone afinalexamination ofthefinal platand provide hisrecommendation onapproval ofthefinalplattotheCouncil, and; Whereas,theCity andtheSubdivider, theirsuccessors andassigns, have reduced to terms aSubdivision Agreement thatwillberecorded withJohnson County, and; Whereas,theinfrastructure improvements aresubject tothree-year maintenance bonds perDesign Standards asapproved byCityCouncil, suchmaintenance bonds tobe posted when theimprovements havebeen completed andaccepted byCity, and; Whereas,theCityrecognizes andconsents tothechanges inthenames ofcertain streets inthedevelopment nowpresent onthefinalplat, and; Whereas Ordinances andSubdivision Agreement. Now,thereforebeitresolved bytheCityCouncil oftheCityofTiffin, Iowathat the Mayor andCityClerk arehereby authorized toexecute thedocuments necessary to approve thefinalplat assubmitted andasapproved bytheCity Engineer and City Attorney, but, asacondition ofitsapproval, theapproval ofthefinal platiscontingent onthefollowing: 1)Execution bytheSubdivider andother necessary parties ofallother documents required bytheSubdivision Ordinance orSubdivision Agreement, including easement agreements; 2)thefinalplat maynotberecorded andnolotsmay be transferred untilthiscontingency have beencompleted. Therecording oftheplatand thisresolution willindicate thiscontingency hasbeen completed. Beitfurtherresolved,thattheSubdivider ofthisproperty willbear thecosttorecord thisresolution and subsequent legal documents withtheOffice oftheJohnson County Recorder. Onthe24 thdayofMarch, 2020, ataregular meeting oftheTiffin CityCouncil, Tiffin, Iowa, Councilperson Schnedler introduced RESOLUTIONNO.2020-018,A RESOLUTIONAPPROVINGTHEFINALPLATOFPARKPLACECITYCENTER TWO,PHASESIX,ASUBDIVISION OFTIFFIN, JOHNSON COUNTY, IOWA and made amotion forapproval. Motion seconded byCouncilperson Havens.
