RESOLUTION NO. 2019-125 RESOLUTION AUTHORIZING CONDEMNATION Whereas, the City of Tiffin, Iowa intends to acquire a portion of and/or an interest in certain real property owned by the City of Coralville with Reverter Rights to the John Powell Rarick and Robert Rarick as Trustees of the Trust created in the Last Will and Testament of Ruth E. Rarick, deceased, which is legally described as: The east half of the northwest quarter of Section 22, Township 80 North, Range 7 West of the 5th P.M. subject to easements, restricts and covenants of record in Johnson County, Iowa; And Whereas, the City of Tiffin, Iowa intends to acquire a portion of and/or an interest in the property which portion is shown on Exhibit A, Exhibit B, Exhibit C, that is attached hereto and incorporated herein by this reference, and which is described as follows: DESCRIPTION - RIGHT-OF-WAY ACQUISITION PARCEL A PORTION OF THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 22, TOWNSHIP 80 NORTH, RANGE 7 WEST, OF THE FIFTH PRINCIPAL MERIDIAN, JOHNSON COUNTY, IOWA, DESCRIBED AS FOLLOWS: Commencing at the Center of Section 22, Township 80 North, Range 7 West, of the Fifth Principal Meridian, Johnson County, Iowa; Thence S89°30'03"W, along the South Line of the Southeast Quarter of the Northwest Quarter of said Section 22, a distance of 33.00 feet, to the POINT OF BEGINNING; Thence continuing S89°30'03"W, along said South Line, 528.93 feet; Thence N68°21'16"E, 120.00 feet; Thence S21°38'44"E, 18.67 feet; Thence S66°38'43"E, 39.24 feet; Thence N68°21'16"E, 205.01 feet; Thence Northeasterly, 164.17 feet, along an arc of a 860.00 foot radius curve, concave Southeasterly, whose 163.92 foot chord bears N73°49'23"E; Thence Northeasterly, 41.91 feet, along an arc of a 30.00 foot radius curve, concave Northwesternly, whose 38.58 foot chord bears N39°16'23"E, to a Point on the West Right-of-Way Line of Jasper Avenue NW; Thence S00°44'44"E, along said West Right-of-Way Line, 157.92 feet, to the said POINT OF BEGINNING.
