STP-A-006-7(90)--22-52 (" Project") which includes construction, reconstruction andnecessary improvements ofstreets, sidewalks, storm sewer, pavement markings, traffic control, signage andditches; and, WHEREAS, theconstruction oftheProject willrequire obtaining additional Right-of-Way from adjoining property owners; and, WHEREAS,theClear Creek Amana Community School District hasagreed todonate the necessary Right-of-Way fortheProject inexchange fortheCityofTiffin paying forany closing cost; and, WHEREAS,theattached Real Estate GiftAgreement reflects that, NOW,THEREFORE, BEITRESOLVEDBYTHECITYCOUNCILOFTHECITYOF TIFFIN,IOWA,authorizes theMayor andCityClerk, toexecute theattached Real Estate Gift Agreement between theCityofTiffin andtheClear Creek Amana Community School District. st Onthe21dayofAugust, 2018, ataregular meeting oftheTiffin CityCouncil, Tiffin, Iowa, Councilperson Schnedler introduced RESOLUTIONNO.2018-083, A RESOLUTIONTOAPPROVEREALESTATEGIFTAGREEMENTBETWEENTHE CITYOFTIFFINANDTHECLEARCREEKAMANACOMMUNITYSCHOOL DISTRICTFORDONATIONOFRIGHT-OF-WAYandmade amotion forapproval. Motion seconded byCouncilperson Havens . Ayes: Ryan, Havens, Schnedler, Upton, Bartels Nays: None Absent: None Whereupon fiveCouncil members were present andvoted approval andMayor Berner declared that the RESOLUTIONNO.2018-083,ARESOLUTIONTOAPPROVEREAL ESTATEGIFTAGREEMENTBETWEENTHECITYOFTIFFINANDTHECLEAR CREEKAMANACOMMUNITYSCHOOLDISTRICTFORDONATIONOFRIGHT-OF- WAYtobeadopted andsignified hisapproval ofthesame byaffixing hissignature thereto. st Passed bytheCityCouncil onthe21dayofAugust, 2018.
