DocuSignEnvelopeID:406C4839-8344-43E6-A3B5-5DC389AA40EA RESOLUTIONNO.2017-065 ARESOLUTIONAPPROVINGFINALPLATOFTIFFINHEIGHTSEAST Whereas,TheBoulders, asSubdivider hasfiled withtheCityClerk oftheCity ofTiffin, Iowa, anapplication forapproval ofthefinalplatofTiffin Heights East, asubdivision of Tiffin, Johnson County, Iowa, which islegally described asfollows: Seeattached Exhibit thatisincorporated intothisagreement AndWhereas,TheCityEngineer hasdone afinalexamination ofthefinal platand provide hisrecommendation onapproval ofthefinalplattotheCouncil, and; Whereas,theCity andtheSubdivider, theirsuccessors andassigns, have reduced to terms aSubdivision Agreement thatwillberecorded withJohnson County, and; Whereas,theinfrastructure improvements aresubject tothree-year maintenance bonds perDesign Standards asapproved byCityCouncil, suchmaintenance bonds tobe posted when theimprovements havebeen completed andaccepted byCity, and; Whereas thefinalplatisfound to Ordinances andSubdivision Agreement. Now,thereforebeitresolvedbytheCityCouncil oftheCityofTiffin, Iowathat the Mayor andCityAdministrator/Clerk arehereby authorized toexecute thedocuments necessary toapprove thefinalplat assubmitted andasapproved bytheCityEngineer andCityAttorney, but, asacondition ofitsapproval, theapproval ofthefinal platis contingent onthefollowing: 1)Execution bytheSubdivider andother necessary parties ofallother documents required bytheSubdivision Ordinance orSubdivision Agreement, including easement agreements; 2)theConditional Dedication and Conveyance document; 3)thefinalplat maynotberecorded andnolotsmay be transferred untilthese contingencies have been completed. Therecording oftheplat andthisresolution willindicate these contingencies have beencompleted. BeItFurtherResolved thattheSubdivider ofthisproperty willbear thecosttorecord thisresolution and subsequent legal documents withtheOffice oftheJohnson County Recorder. th Onthe15 dayofAugust, 2017, ataregular meeting oftheTiffin CityCouncil, Tiffin, Iowa, Councilperson Ryan introduced ResolutionNo.2017-065RESOLUTION APPROVINGTHEFINALPLATOFTIFFINHEIGHTSEAST,ASUBDIVISION OF TIFFIN, JOHNSON COUNTY, IOWAand made amotion forapproval.
